DVI Media LLC - Terms and Conditions

For residential photography packages, all photos will be delivered by the end of the next business day following the shoot. Business hours are Monday through Friday, 10 am to 3 pm. DVI Media LLC is closed on public holidays.
Video Tour Package: Delivery will be made within 2 business days following the shoot.
For commercial photography packages, the standard turnaround time is 3 business days from the date of the shoot.

Residential and Video Tour Packages:
- Ownership: All photos and videos produced by DVI Media LLC remain the intellectual property of DVI Media LLC.
- License Grant: Clients are granted a non-exclusive, non-transferable license to use the photos and videos solely for the purpose of listing the property or for rental advertising.
- Prohibited Uses: Redistribution, sharing, or use of the photos and videos by third parties such as interior designers, construction companies, or other realtors is strictly prohibited. This includes, but is not limited to, use in brochures, marketing materials, websites, or any other promotional avenues.
- Licensing for Third Parties: Third parties interested in using the photos or videos must directly contact DVI Media LLC to obtain a license. Unauthorized use will be subject to legal action.
Commercial Photography Packages:
- Usage rights are included in the price when booking a commercial photography package.
- Clients are not permitted to sell or transfer the photos to another business under any circumstances.
- Clients are allowed to:
  - Edit the images for marketing purposes.
  - Use the images on their website and other promotional materials.

Cancellations: If a client cancels a booking, they will be charged 50% of the total booking cost. This is to compensate for the time slot which could have been allocated to another client.
Rescheduling: Clients are allowed to reschedule their bookings up to three times. Any further rescheduling will incur a fee of 50% of the total booking cost. This is to ensure the efficient allocation of resources and time slots.

Coverage Area: Any listing within our standard service area does not incur travel fees.
Outside Coverage Area: For locations outside the standard service area, a travel fee of $100 per hour will be charged. This fee covers both the journey to the location and the return trip.

Payment Due Date: If the client does not make the payment during the booking process, the payment is due within 24 hours of receiving the photos or videos. The client’s card on file will be used on the 7th day from when the photos and/or videos have been sent to pay the full outstanding balance.
Late Payment: Failure to make the payment within the stipulated time may result in withholding of future services and potential legal action to recover the dues.
Refunds: Once the service has been rendered and the photos or videos have been delivered, no refunds will be provided.
Right to Refuse: DVI Media LLC reserves the right to refuse service to any client, especially in cases where there have been previous disagreements, non-payment, or violation of terms.

5 Residential Photography Bundle: This package will still incur the standard travel fees as outlined in Section 4.
10 Residential Photography Bundle: This package will also incur the standard travel fees as outlined in Section 4.

By booking with DVI Media LLC, you agree to the terms outlined above. These terms are subject to change, and it is the client’s responsibility to review the most current version on the DVI Media LLC website.

8. Photo Accessibility

Link Availability: Photos delivered via a link will remain accessible for 30 days from the date of delivery.
Client Responsibility: It is the client’s responsibility to download and securely store the photos. After 30 days, DVI Media LLC cannot guarantee continued accessibility unless otherwise agreed upon in writing.
